Types of Hernias

Hernias occur when an organ or tissue squeezes through a hole or gap in the surrounding muscle or connective tissue. Hernias may occur in the upper abdomen, the lower abdomen or the groin area. Anything that causes an increase in pressure in the abdomen such as lifting, having a bowel movement or even coughing can cause a hernia. Weaknesses in tissue caused by incisions also can cause hernias.

The common types of hernias include:

  • Inguinal Hernia (inner groin)
  • Incisional Hernia (from incision in the abdomen)
  • Umbilical Hernia (at the belly button)
  • Femoral Hernia (in the upper thigh)
  • Hiatal Hernia (upper stomach).

More than 1 million hernia repairs are performed each year in the U.S., and approximately 800,000 are to repair inguinal hernias, the most common type. Most hernia repairs involve the use of surgical mesh.

What is Hernia Mesh?

Hernia mesh is a medical device implanted during hernia repair surgery to reinforce weakened tissue and prevent the recurrence of a hernia. Hernia mesh may be woven of synthetic materials or made of animal tissue from pigs or cows. Synthetic mesh may be made of absorbable material, non-absorbable material or a combination of both types of material.

In recent decades, surgeons have relied increasingly on surgical mesh while performing hernia repairs. Medical studies have shown that the use of hernia mesh correlates with a reduction in the hernia recurrence rate. But some types of defective hernia mesh have caused an unreasonably high number of complications and been recalled or withdrawn from the market.

What are Hernia Mesh Complications?

The most common complications are pain, infection, blockage of the bowel, unintended attachment of the mesh to an internal organ, migration of the mesh inside the body and recurrence of the hernia.

If you experience complications, you may have to have follow-up hernia surgery to remove and replace the defective hernia mesh and repair any internal tissue damage caused by the mesh. A surgeon may have to do exploratory surgery to find the mesh if it has migrated inside the body. Some complications of hernia mesh can be serious or life-threatening, such as perforation of an organ.

You may be out of work for an extended period of time recovering from an injury caused by defective hernia mesh.

Hernia Mesh Recall

Some brands of hernia mesh have been recalled or withdrawn from the healthcare market.

Atrium Medical Corporation, a subsidiary of Maquet Holding, produced the C-QUR™ Mesh, which was used in hernia repairs from 2006 until 2015, when federal regulators obtained a court order to shut down three Maquet facilities for repeatedly failing to correct major safety violations including issues involving sterilization. Under the terms of the court order, a number of Atrium mesh products are no longer available, including the C-QUR Hernia Mesh (including Vpatch, Tacshield, FX, Mosaic and Film), according to the U.S. Food and Drug Administration.

Another medical device manufacturer, Ethicon, Inc., introduced a hernia mesh product called Physiomesh™ Flexible Composite Mesh in 2010 for use in laparoscopic hernia repairs. In 2016, Ethicon pulled the product off the market. In announcing the decision, Ethicon said an analysis of patient data from two European health registries showed that hernia patients who had Physiomesh™ Flexible Composite Mesh implanted had unacceptably high rates of complications requiring repeat surgeries.

Many patients who have undergone hernia repairs involving recalled hernia mesh still have the mesh implanted inside them and may still develop serious complications. If you develop complications from your hernia mesh, you may be entitled to seek compensation for your medical expenses, loss of incomes, and pain and suffering related to the defective medical device.

Am I Eligible to File a Lawsuit?

You may be entitled to file a personal injury lawsuit if you have been harmed by faulty hernia mesh. Manufacturers of medical devices including hernia mesh products are required by law to make products that are safe and effective when used as intended and to give adequate warning of any known side effects.

When medical devices cause injuries due to design defects or manufacturing defects, the manufacturer may be held liable for the damages. Numerous lawsuits have been filed by patients injured by defective hernia mesh products against the manufacturers.

If you file a product liability lawsuit involving hernia mesh, you are suing the manufacturer, NOT your doctor.

The family of an individual who died of hernia mesh complications may be entitled to bring a lawsuit for the death of their loved one.
